Allgemeine Geschäftsbedingungen (AGB)
1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge zwischen [Name der Designerin](nachfolgend „Designer/in“) und ihren Kundinnen und Kunden (nachfolgend „Kunde“) im Bereich Design- und Kreativdienstleistungen.
2. Leistungen
Der Designer erbringt Dienstleistungen in den Bereichen Grafikdesign, Webdesign, Branding und ähnliche kreative Leistungen. Der konkrete Leistungsumfang ergibt sich aus der jeweiligen Offerte bzw. dem individuellen Vertrag.
3. Vertragsschluss
Ein Vertrag kommt zustande durch:
Annahme einer Offerte des Designers durch den Kunden, oder
schriftliche Bestätigung eines Auftrags (z. B. per E-Mail).
4. Preise und Zahlungsbedingungen
Alle Preise verstehen sich in Schweizer Franken (CHF), sofern nicht anders angegeben.
50 % Anzahlung bei Projektstart
50 % Restzahlung nach Fertigstellung
Rechnungen sind innerhalb von 14 Tagen ohne Abzug zahlbar. Bei Zahlungsverzug kann der Designer Verzugszinsen erheben.
5. Mitwirkungspflichten des Kunden
Der Kunde verpflichtet sich, alle für die Leistungserbringung notwendigen Informationen, Inhalte und Materialien rechtzeitig bereitzustellen.
Verzögerungen durch fehlende Mitwirkung können zu Terminverschiebungen oder Mehrkosten führen.
6. Urheberrechte und Nutzungsrechte
Alle vom Designer erstellten Werke unterliegen dem Urheberrecht.
Nutzungsrechte gehen erst nach vollständiger Bezahlung auf den Kunden über
Ohne ausdrückliche Vereinbarung erhält der Kunde ein einfaches, nicht exklusives Nutzungsrecht
Weitergabe oder Bearbeitung ist nur mit Zustimmung des Designers erlaubt
7. Referenznutzung
Der Designer ist berechtigt, abgeschlossene Projekte zu Referenzzwecken (z. B. auf Website oder Social Media) zu verwenden, sofern nichts anderes vereinbart wurde.
8. Korrekturen und Zusatzleistungen
Im Angebot enthalten sind [z. B. 2–3] Korrekturschleifen.
Weitere Änderungen oder zusätzliche Leistungen werden nach Aufwand berechnet.
9. Haftung
Der Designer haftet nur für vorsätzlich oder grob fahrlässig verursachte Schäden.
Für Inhalte, die vom Kunden bereitgestellt werden (Texte, Bilder etc.), übernimmt der Designer keine Haftung.
10. Termine und Fristen
Termine werden nach bestem Wissen eingehalten. Verzögerungen durch höhere Gewalt oder fehlende Mitwirkung des Kunden führen nicht zu Schadensersatzansprüchen.
11. Vertragsauflösung
Bei vorzeitiger Kündigung durch den Kunden sind bereits erbrachte Leistungen zu vergüten.
Anzahlungen werden nicht zurückerstattet.
12. Datenschutz
Der Designer behandelt alle Kundendaten vertraulich und gemäss den geltenden Datenschutzbestimmungen.
13. Schlussbestimmungen
Es gilt Schweizer Recht.
Gerichtsstand ist [Ort einsetzen].
Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

GENERAL TERMS AND CONDITIONS (GTC)
Fashion Design & Creative Services
Atelier Caja / Julia Klink

1. Scope of Application
These General Terms and Conditions (GTC) apply to all agreements between Julia Klink / Atelier Caja (hereinafter referred to as the “Designer”) and her clients (hereinafter referred to as the “Client”) in connection with fashion design, product development, creative consulting and related design services.
These GTC form an integral part of each quotation, project agreement or order confirmation, unless otherwise agreed in writing.
2. Services
The Designer provides individual fashion design and creative services, which may include, depending on the individual project:
fashion and collection concepts
design development and creative direction
hand-drawn or digital fashion sketches
technical drawings and technical specifications
worksheets and tech packs
fabric and material research and sourcing
colour and material concepts
trend and market analysis
garment development and product development
support during sampling and fittings
communication and coordination with pattern makers, manufacturers and other production partners
creative consulting and related services
The exact scope of services, deliverables, timelines and fees are defined in the respective quotation or individual project agreement.
3. Conclusion of Contract
A contract is concluded by:
the Client’s acceptance of a quotation submitted by the Designer; or
written confirmation of an order or project, including confirmation by email.
Any changes to the agreed scope of services must be agreed upon in writing.
4. Prices and Payment Terms
All prices are stated in Swiss francs (CHF), unless otherwise agreed.
Unless otherwise specified in the quotation:
50% deposit is payable upon commencement of the project.
50% final payment is payable upon completion of the agreed services.
Invoices are payable within 14 days without deduction.
In the event of late payment, the Designer may charge statutory default interest.
Any costs incurred by the Designer on behalf of the Client, including samples, materials, shipping, travel or external services, may be charged separately if agreed or approved by the Client.
5. Client’s Duty to Cooperate
The Client shall provide all information, materials, references, specifications and decisions required for the timely execution of the project.
The Client is responsible for ensuring that any materials, images, logos, texts, designs or other content supplied by the Client may legally be used for the intended purpose.
Delays caused by missing information, late feedback, changes in requirements or other circumstances attributable to the Client may result in adjusted deadlines and/or additional costs.
6. Design Development and Revisions
The number of design proposals, sketches, revisions, fittings or development stages included in the agreed fee will be specified in the quotation.
Unless otherwise agreed, the agreed fee includes [e.g. 2–3] rounds of revisions.
Additional revisions, changes to an approved design, new design directions or additional development work will be charged separately based on the time and effort required.
Once a design or development stage has been approved by the Client, subsequent changes may be treated as additional work and charged accordingly.
7. Copyright and Intellectual Property
All designs, sketches, illustrations, technical drawings, concepts, specifications, worksheets, documents, creative ideas and other materials created by the Designer remain the intellectual property of the Designer unless expressly agreed otherwise in writing.
The Client does not acquire ownership of the Designer’s intellectual property merely through payment of the design fee.
Unless otherwise agreed in writing, the Client receives a non-exclusive right of use for the specific purpose and scope agreed upon in the project.
Any transfer, licensing to third parties, commercial exploitation beyond the agreed purpose, substantial modification or reproduction of the Designer’s work requires the Designer’s prior written consent.
The Designer remains free to use general knowledge, techniques, methods and experience gained during a project for other projects and clients.
8. Commercial Use and Production
Where designs are developed for commercial production, the Client’s right to produce and commercially exploit the designs is subject to the agreed usage rights and full payment of all outstanding fees.
Unless explicitly agreed otherwise, the Designer does not guarantee that a design will be commercially successful, technically producible by a particular manufacturer, or free from third-party intellectual property rights.
The Client is responsible for obtaining any necessary production, trademark, licensing or other legal clearances relating to the commercial use of the final product.
9. Samples, Prototypes and Production Partners
Where the Designer supports the development of samples, prototypes or production, the Designer may work with external pattern makers, sample makers, manufacturers, suppliers or
